Protek

These Terms and Conditions (“Terms”) govern the provision of services and the sale or rental of equipment by Protek (“we”, “our”, or “us”). By engaging our services, purchasing products, renting equipment, or participating in training provided by Protek, you agree to be bound by these Terms.
1. Services
Protek provides services including but not limited to:
- Domestic appliance servicing and repairs
- Commercial appliance servicing and repairs
- Electrical appliance testing and tagging
- Machinery rental
- Machinery sales
- Training and certification services
- Related technical and consulting services
2. Quotes and Estimates
- All quotations are valid for 30 days unless otherwise stated.
- Quotes are based on information available at the time of preparation.
- Additional work, parts, labour, or unforeseen repairs may result in additional charges.
- Any significant variation will be discussed with the customer before proceeding where reasonably practicable.
3. Service and Repair Work
- Protek will carry out repairs and servicing with reasonable care and skill.
- Repair completion times are estimates only and are not guaranteed.
- We are not responsible for delays caused by parts availability, supplier issues, weather events, or circumstances beyond our control.
- Customers must ensure equipment presented for service is safe and accessible.
4. Customer Responsibilities
Customers agree to:
- Provide accurate information regarding equipment faults and operating conditions.
- Ensure safe access to equipment and work areas.
- Remove valuable or sensitive items before service work begins.
- Follow any operating instructions provided by Protek.
Additional charges may apply if access is restricted or conditions differ from those originally advised.
5. Parts and Materials
- Replacement parts may be new, refurbished, or equivalent quality parts unless otherwise agreed.
- Availability of parts is subject to supplier stock.
- Ownership of supplied parts remains with Protek until payment has been received in full.
6. Testing and Tagging Services
- Testing and tagging is conducted in accordance with applicable New Zealand standards and industry requirements.
- A pass result indicates compliance at the time of testing only.
- Protek accepts no responsibility for equipment failures occurring after testing due to misuse, damage, wear, modification, or other circumstances beyond our control.
- Customers remain responsible for maintaining safe equipment between inspection intervals.
7. Training Services
- Participants must comply with all safety requirements and instructions during training.
- Protek reserves the right to remove participants who engage in unsafe, disruptive, or inappropriate behaviour.
8. Machinery Rental
Rental Period
- Rental charges apply for the agreed rental period.
- Additional charges may apply for late returns.
Customer Responsibilities
The customer is responsible for:
- Proper operation of rented equipment.
- Daily care and maintenance during the rental period.
- Securing equipment against theft, loss, or damage.
Damage and Loss
- Customers are liable for loss, theft, misuse, or damage occurring during the rental period, except where caused by normal wear and tear.
- Repair or replacement costs may be charged to the customer.
Equipment Return
- Equipment must be returned in a clean and serviceable condition.
- Cleaning, repair, transport, or recovery fees may apply where necessary.
9. Machinery Sales
- All products remain the property of Protek until payment is received in full.
- Product specifications may change without notice due to manufacturer updates.
- Customers should ensure purchased equipment is suitable for its intended purpose.
10. Warranties
Repair Warranty
Unless otherwise stated:
- Repairs performed by Protek are covered by a 30-day workmanship warranty.
- The Warranty Period commences on the invoice date and expires on the agreed date. Any warranty repairs or replacements provided during this period shall not extend the original Warranty Period.
- Warranty applies only to the specific repair carried out.
- Warranty does not cover misuse, accidental damage, normal wear and tear, unauthorized repairs, or external causes.
Product Warranty
Products sold may be covered by manufacturer warranties where applicable.
Nothing in these Terms excludes any rights available under the:
- Consumer Guarantees Act 1993
- Fair Trading Act 1986
- Other applicable New Zealand legislation
11. Payment Terms
- Payment is due on the date specified on the invoice unless otherwise agreed in writing.
- Protek may require deposits for certain services, rentals, orders, or training bookings.
- Late payments may incur collection costs, legal fees, and interest where permitted by law.
- Customers are responsible for all reasonable recovery costs associated with overdue accounts.
12. Limitation of Liability
To the maximum extent permitted by law:
- Protek’s liability is limited to the value of the service, repair, rental, or product supplied.
- We are not liable for indirect, consequential, special, or economic loss including loss of profits, business interruption, or loss of data.
- We are not responsible for damage resulting from equipment defects existing prior to our service.
Nothing in these Terms limits any rights that cannot legally be excluded under New Zealand law.
13. Health and Safety
Customers must provide a safe working environment for Protek employees and contractors.
Protek reserves the right to suspend or refuse work where:
- Unsafe conditions exist.
- Health and safety requirements are not met.
- Equipment presents an unreasonable risk.
Charges may apply where work cannot proceed due to unsafe conditions.
14. Privacy
Personal information collected by Protek is handled in accordance with our Privacy Policy.
15. Force Majeure
Protek will not be liable for delays or failure to perform obligations caused by events beyond our reasonable control, including:
- Natural disasters
- Floods
- Earthquakes
- Fire
- Pandemics
- Government actions
- Supply chain disruptions
- Power outages
16. Governing Law
These Terms and Conditions are governed by the laws of New Zealand.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
